Case-Brief-United-States-V-Watts

Case Brief Assignment

For your case brief assignment, you should review the case you were assigned. The case brief should be written according to the following guidelines, using the bolded topics as section headings in the order specified. While this is not meant to be a lengthy assignment, it will be quite difficult to put together a brief in less than 1 page (typed, double-spaced, 12 font/Times New Roman). The brief may “spill over” for lengthy cases with a number of issues and opinions.Part of what makes a case brief effective is its length, so for basic opinions that are less than one page, but that go over two pages, or for longer/more complex opinions that do more than “spill over” onto page three, points will be deducted.

Title and Citation: List the name of the case, the citation listed in text, and the year.

Facts: You should present the relevant facts necessary to understand the “story line” and pertinent to the issue(s) raised. Make sure that you write it in such a way that not only you understand it, but that someone reading it without knowledge of the case can understand the case enough to discuss the issues. You mustparaphrase.

Issue(s): The only relevant issue(s) is/are the one(s) that result in a decision by the Court. Each issue should be ONE line. To be safe, you should (but are not required) to word the issue as, “whether…” (e.g., whether capital punishment is disproportionate to the crime of rape committed by an adult, thereby violating the 8th Amendment cruel and unusual punishment clause). You can frame the issue as a question if you choose (e.g., Is capital punishment disproportionate to the crime of rape committed by an adult, thereby violating the cruel and unusual punishment clause of the 8thAmendement?)

Holding: The holding should be one word to one sentence and directly address the issue(s) you identified. The holding should reflect the majority opinion. Do not identify dissents or multiple opinions (sometimes justices agree on the outcome, but for multiple reasons, in which case more than one justice in the majority may write an opinion).

Opinion/Reasoning: This may be the most difficult part of writing a case brief, as the reasoning in the court’s opinion will often go “back and forth” and refer to other cases. You should distill the reasoning down to key points that explain the court’s decision. You should summarize the key justification points in your own words. Your discussion is limited to the reasoning of the Court for the majority opinion.

Dissenting Opinion: Do not go into detail, just 1-2 sentences summarizing the disagreement.

Your Opinion: In this section, you are to critically analyze the opinionof the court and state your own conclusion as to how you would rule on the issue(s) raised in the case. You should state your own reasoning to support your conclusion. You are free to agree or disagree with the court’s opinion and/or dissent.

Case: Name of the case, (and year of the decision).

Facts: Who are the parties to the lawsuit, what is their dispute, and how did they get to the Supreme Court? In your own words, only include the few important facts necessary to understand the case; e.g. the time of day a defendant was arrested is usually not important, etc.

Issue: What is the basic legal question regarding what specific provision of law that is to be decided in the case?

Holding: What is the majority’s basic answer to the basic legal question in the case. Also include the vote count: majority/plurality—concurrence(s)—dissent(s)

***Majority Opinion Reasoning: What is the majority’s explanation why it reached its holding? You will want to create a summarized, condensed, paraphrased outline of the court’s reasoning. The reasoning simply consists of two things: the RULE and the APPLICATION (of the rule to the facts of the case):

A. Rule: What rule of law is announced in the case? A court first must announce a specific controlling principle of law (e.g. the court’s interpretation of a constitutional provision, NOT the constitutional provision itself!) that applies to the issue in the case. This is also the abstract, general legal principle that will be applied to all future cases involving this issue, using this case as a precedent, and it is important to understand under what factual circumstances the rule applies. Often the court will usually explain why the rule is being created or applied, such as the origin of the rule, or the policy behind the rule existing, and also will often explain why any alternative rules proposed by the parties or the dissenting justices are being rejected. Here the court usually looks at the words of a constitutional or statutory provision, the original intent behind that law, and public policy arguments. These are not the rule itself, but the explanation of, or justification for, the rule. You must quote precisely the actual rule itself (but not the explanation for the rule) that the court finally adopts and decides to apply; the actual wording of the rule itself is known as the “black letter law.” The rule itself must be quoted because every word matters: there is a huge difference between “a” and “the” or between “may” and “must” etc. But the justification for the rule should be primarily in your own words.

B. Application: How does the rule of law specifically apply given the specific facts of the case at issue? In other words, given the rule of law that should apply, which party wins according to that rule given the facts of the case being heard? The reasoning of the court here should consider the facts of the case, and might analogize or distinguish the facts of the current case to the facts of earlier similar or related cases. You should explain all this in your own words, quoting only an occasional word or phrase.

Concurring Opinion(s) Reasoning: What is the reasoning of each separate concurrence (justices who agreed with the majority’s holding but disagreed with the majority’s reasoning)? How do they differ in their proposed rule or application (or both)?

Dissenting Opinion(s) Reasoning: What is the reasoning of each separate dissent (justices who disagreed with both the majority’s holding and its reasoning)? How do they differ in their proposed rule or application (or both)?

Judges and their names and logic in the dissenting opinion.

a-small-discussion-1

Watch this video, then write a discussion by the question and requirement.

Make sure do not plagiarize, Use your own word to write what you think.

Businesses have many responsibilities and stakeholders. It’s not simply their stockholders/owners or their customers they must address. As a business person, why do you care about your stakeholders and community beyond your customers? There are costs associated with social responsibility. Does that matter? Some companies attract a great deal of negativity about their products. Should they care? Are there benefits to businesses engaging in social initiatives? Does it matter if they are sincere or not?

Do not post answers to these specific questions. They are rhetorical to get you thinking about this topic: Stakeholders, Social Responsibility. There are no right or wrong answers for this discussion. It will morph as your classmates start replying. Some of you may give examples of companies with either positive or poor social engagement. Others might highlight their own plans if they had a business. You can also be a contrarian.

research-question-and-hypothesis

Throughout this course, many opportunities are available to post an initial response to a Discussion topic as well as to respond to your classmate’s responses. After you have completed the reading, and without reviewing your classmate’s responses, post your initial response to the following Discussion. Your post should be at least 300–350 words in length and should extend the discussion of the group supported by your course materials and/or other appropriate resources. After you have submitted your initial post, review some of your classmate’s posts and post at least two substantial responses to peers. Refer to the Discussion Board Rubric in Course Resources for specific grading requirements.

As one step in the scientific method, after choosing a topic and forming a research question and hypothesis, researchers need to decide what type of research design they want to use. As you have learned during class, there are many different methods that a researcher could use. It can be helpful to think through the different options prior to determining what method to use. It is important to think of what is most needed from your study results when choosing what method to use. For example, is internal validity or external validity more important? As all methodologies have limitations, what are limitations that you can “live with” in regards to studying your research question? A researcher who wants to prioritize results that generalize to real world settings would likely want to prioritize strong external validity and be able to “live with” limitations to internal validity. A researcher who wants to be able to make strong causal inferences from the results would likely want to prioritize strong internal validity and be able to “live with” limitations to external validity.

Think of a topic of interest to you that involves comparing two groups of people. Then choose one of the following to answer:

A: Discuss how a quasi-experimental design could be used to study your topic.

  • What is your research question, hypothesis, and target population?
  • Why would a quasi-experimental design be better to use than other study methods for this topic?
  • What are strengths and limitations of your study that result from using a quasi-experimental design?

B: Discuss how a single factor experimental design could be used to study your topic.

  • What is your research question, hypothesis, and target population?
  • Why would a single factor experimental design be better to use than other study methods for this topic?
  • What are strengths and limitations of your study that result from using a single factor experimental design? Passer, M. W. (2014). Research methods: Concepts and connections.

Management of a Network

TASK – 1

a) Summarize the attached research article in One to two pages. the summary should include the main idea presented in the paper with appropriate explanation. b) Write your reflection on the network management architecture from the research paper.(advantages, disadvantages, etc) (Proper Referencing and documentation is required).

TASK – 2

As a network manager for a small/medium company, you are required to be aware of the health of your LAN and help in taking decisions regarding its growth, security and utilization rules by remotely monitoring some probes. You started your Remote monitoring project by setting a number of objectives:

1. The current utilization percentage of the bandwidth and its trend.

2. Create history reports

3. Know which conversations (communicating hosts) are generating most traffic.

4. Define the settings to capture a specific type of frames.

5. Set a number of alarms raised by some critical states.

6. Monitor the traffic for some upper layer’s traffic.

Task 2.a:

For each objective described in this task, you are required to find the RMON group and tables that will be pulled to get or set from it some parameters as well as all objects that will be used. For some objectives, you need to set first the control table associated.

Example: To determine the traffic statistics with one host, we need to access the tables: “hostControlTable” and “hostTable” in the Host group.

The objects that can be invocated: In “hostControlTable”: hostControlTableSize and hostControlLastDeletedTime, hostControlStatus, hostControlIndex. In “hostTable” : hostAddress, hostCreationOrder and hostIndex.

Task 2.b:

you need to give an example for the selected objects with a clear explanation.

Example: In “hostControlTable”: hostControlTableSize=10: The number of hostEntries in the hostTable is 10. It is calculated by

counting distinct MAC addresses in the frames read.

hostControlLastDeletedTime=0;is the value of sysUpTime in the System group of mib-2 at which a row in the hostTable was deleted. If no deletion was done than this number is set to 0.

For all other objects described in task a), you need to provide an example and its explanation.

***how many groups in the Object

***if one, write about it and write about the tables in it?

***if more than one group, write about them and write about the tables included in each group

Task 2.c:

You are required to conduct a comparison research about 5 Open source tools for Network monitoring and write a report based on it. The report must include the features and limitations of each tool.

*** Citation and Referencing Using CU Harvard Style is Required.

*** Support your answers with diagrams or graphs.

*** Word Count: Min 3000 words

answer-the-following-discussion-board-question

NOTE: As you work on the following items below, you may want to refer back to Appendix B in Engel and Schutt.

Based upon your reading of Pomeroy, Kiam, and Abel (1999; see the attached .pdf), address the following:

Section I: Critique of the Article’s Introduction/Literature Review (p. 171–174)

In your own words, what was the overall purpose of Pomeroy et al.’s research study? Was the literature review adequate and relevant? That is, did it lend support to the current study? If yes, how so? If no, speak to the limitations/weaknesses of the literature review and provide recommendations for how it could be strengthened.

Section II: Critique of the Article’s Methodology (p. 174–179)

What type of sampling approach was used in general (re: probability or non–probability) and specifically (e.g., simple random, stratified random, etc.)? Identify the research design. That is, would you classify this as a pre–experimental, quasi–experimental, or experimental study? How did you come to that conclusion? Did Pomeroy et al. sufficiently inform their audience of potential threats to the internal and/or external validity of their study that stem from the research design? Briefly explain your response.

Section III: Critique of the Article’s Discussion (p. 182–185)

Did Pomeroy et al. adequately acknowledge the strengths and limitations of their study? Briefly explain your response. Are there other strengths and limitations that were not identified? Be specific. If you were to build upon this study, discuss how you would handle the sampling strategy and research design in order to enhance causality (re: strengthen enhance your ability to make causal inferences that the intervention is responsible for the outcomes).

NOTE: As you review the article, back up your critique by citing the relevant page(s) from the article. Please note, initial posts should be between 300 and 500 words. As applicable, relate and support your initial post with what you learned from the course materials for this week and any other resources you want to share (e.g., from prior courses), using standard APA citations. In addition to starting a discussion by making your initial post, you are required to read the postings of fellow students and respond to at least two other initial posts. Your responses should elaborate on the initial postings of your colleagues (e.g., exchange ideas, debate points, and/or add to their ideas) and should be approximately 150 words each.
